Riverside County Superior Court Judge Molloy denied HFFA's motion for a preliminary injunction in the case because the HFFA had not proved irreparable harm or a likelihood that HFFA would prevail on the merits at trial. This was the second time Judge Molloy had denied HFFA's motion for a preliminary injunction in the case. HFFA also previously suffered defeats when the Court twice denied HFFA attempts to obtain Temporary Restraining Orders against the City. The City's attorney requested that the Court set the matter for trial so that the dispute could be resolved at the earliest possible date and the Court set a trial date of January 30th.
